“Birdies for St. Jude” Contest Rules
The Birdies for St. Jude Contest(the “Contest”) is a program conducted by American Lebanese Syrian Associated Charities, Inc. (“ALSAC”) to benefit St. Jude Children’s Research Hospital (“St. Jude”). These Rules apply to all participants. The Sponsors shall make all determinations as to whether the Rules have been complied with, and the decision of the Sponsors as to any issue is final.
Sponsors: ALSAC, St. Jude Children’s Research Hospital, Youth Programs, Inc. (dba Fedex St. Jude Classic) and Landers Ford of Memphis, Tennessee are the Sponsors of this Contest.
Eligibility: No donation is necessary to participate in the Contest. Participants must be 18 years of age or older, as of the closing date for entries. A donation will not increase one’s chance of winning. The Contest is open only to residents of the50 United States and District of Columbia. Employees of ALSAC, St. Jude, Youth Programs, Inc., Landers Ford, or its corporate affiliates, the 156 player participants themselves; and any member of the immediate family of any such person are not eligible to enter or win.
For this purpose, “immediate family” means the person’s spouse, parents, in-laws; and children and grandchildren and their spouses. This definition includes “step” and adoptive relationships, individuals for whom a person is the legal guardian, and individuals who are not legally related to a person, but who reside with the person.
Entry: You will be entered to win by registering at www.birdiesforstjude.com. Limit one (1) entry per person.
Time: The Contest starts at12:01 a.m. (all times Eastern Time) on or about April 1, 2013 and ends at 11:59 p.m. on June 8, 2013 (the "Contest Period"). All entries must be received during the Contest Period to be eligible to win the prize.
Prize: The prize consists of a 2013 Ford Explorer XLT from available stock on the Landers Ford lot (“the Prize” or “the Vehicle”). The optional equipment included on the Vehicle will be determined by Landers Ford of Memphis.
The manufacturer suggested retail price of the prize is $33,255.98. However, the actual value may be more or less than this amount.
Determination of Winner: Only one (1) Prize will be awarded. The Prize will be awarded to the person who guesses the exact number of birdies made by players during official play in the FedEx St. Jude Classic™ (FESJC) Golf Tournament, and including any birdies made during a playoff. The guess may be any number. In the event of a tie, the Winner will be chosen by a random drawing by PGA TOUR Officials from among those who guessed the correct number of birdies made. If no one guesses the correct number of birdies made, the Winner will be the person who is closest over or under the actual birdie total. In the event of a tie, the Winner will be determined by a random drawing as described above. If any round is canceled for any reason, the average number of birdies made during the rounds actually played (excluding any playoff) will be added to the birdies actually made (including any playoff), and the total will be the “exact number of birdies made” for purposes of the Contest. The exact number of birdies made during the FESJC will be determined by PGA TOUR Officials in accordance with these rules. No entrant is required to be present to win. The Winner will be notified by e-mail, and subsequently announced to the public. The Winner will be notified no later than June 14, 2013. The selection of the Winner is final and binding on all participants.
The Prize may be forfeited and awarded to an alternative Winner if the Winner does not respond within fifteen (15) days of notification being sent to the Winner and if two (2) attempts to contact Winner by email are not successful.
Winner’s Responsibilities: The Winner is responsible for sales tax, registration, and any accompanying related fees in the state in which the Prize is titled, and for purchasing any liability insurance with respect to the vehicle. The Winner is responsible for taking possession of the Vehicle at the tournament site, or at Landers Ford, in Memphis Tennessee, not later than June 30, 2013. The Winner agrees that neither ALSAC nor St. Jude shall be responsible for any defect or any other problem arising out of the design, manufacture, transport, display or other factor related to the Vehicle.
Taxes: The value of the Prize is includible in the Winner’s gross income for federal and most state income tax purposes. ALSAC is required to report the actual value of the Prize to the Internal Revenue Service. The Winner agrees to provide his or her valid name, address, and Social Security number to ALSAC for tax reporting purposes. The Winner is responsible for paying all federal, state, and local income and other applicable taxes that are due in connection with receipt or ownership of the Vehicle. The Winner should consult with a tax advisor.
Additional Agreements: The Winner will be required to execute an Agreement with Landers Ford of Memphis and an Agreement with ALSAC/St. Jude as a condition of accepting the Prize. All agreements include releases of liability in favor of Landers Ford of Memphis, ALSAC and St. Jude, respectively.
Consent to Publicity. By entering the Contest, the Winner consents to ALSAC/St. Jude use of his or her name and/or photograph in any publicity, publications, promotional and marketing material, advertising, and any other print materials, web pages, or electronic or other communications published or distributed by ALSAC/St. Jude, and to sign a separate agreement to this effect.
Miscellaneous Conditions: In the event that the operation or administration of the Contest is impaired or prevented in any way for any reason, including, but not limited to fraud, change of condition, or other technical problems, the Sponsors may in their sole discretion, either: (a) terminate the Contest; (b) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Rules; and/or (c) substitute other prizes for any prize set forth in these Rules that becomes unavailable for any reason. The Sponsors reserve the right in their sole discretion to disqualify any individual found to be tampering with the entry process or the operation of the Contest or acting in violation of these Rules.
The determinations of ALSAC/St. Jude are final and binding with respect to any matter arising out of the interpretation or application of these terms and conditions.
For a confirmation of the Winner, send a hand-written, self-addressed, stamped envelope to Birdies for St. Jude Contest, ALSAC/St. Jude Children’s Research Hospital, 501 St. Jude Place, Memphis, TN 38105. Requests for the identity of the Winner must be received by July 15, 2013.
