Birdies for St. Jude Rules and Regulations



Official Rules. No purchase or donation necessary. A purchase or donation will not increase your chances of winning.

  1. Eligibility: Birdies for St. Jude Contest (the "Contest ") is open to legal residents of the U.S., 18 or older as of April 24, 2006. Employees of FedEx Corporate Services, Inc. (“Sponsor”) Youth Programs, Inc. (dba FedEx St. Jude Classic) ALSAC/St. Jude Children’s Research Hospital and each of their respective parent companies, subsidiaries, affiliates, agents, distributors, divisions, trustees, franchisees, participating retailers, participating vendors, advertising/promotion agencies, their designees and assigns and each of their respective officers, directors and employees (collectively “Released Parties”) and the immediate family members and/or those living in the households of any such persons are not eligible to win Prizes but may submit pledges. Void where prohibited.
  2. Sponsor: FedEx Corporate Services, Inc., 3640 Hacks Cross Rd., Memphis, TN 38125 and ALSAC/St. Jude Children’s Research Hospital, 501 St. Jude Place, Memphis, TN 38105.
  3. Timing: The Contest begins at 12:01:00 a.m. Central Standard Time ("CST"), April 24, 2006, and ends at 5:00:00 p.m. CST, May 27, 2006 (the “Contest Period”). 
  4. To Enter: To enter on-line visit www.birdiesforstjude.com and follow the entry link and provide the requested information. Official Entry Forms are available for mail in entry at FedEx World Service Centers, participating FedEx Kinko’s locations in the Memphis and Nashville TN, Little Rock AR, Jackson MS markets.  Official entry forms may also be obtained, completed and submitted at the designated locations during the tournament on the FedEx St. Jude Classic tournament grounds. Mail in entries are to be sent to Birdies for St. Jude, 501 St. Jude Place Memphis, TN 38105.
  5. To Play:  Guess the exact number of birdies made by players in the FedEx St. Jude Classic, 156-player field Thursday through Sunday of Tournament Week, (May 25- 28, 2006) (the “defined measurement period”) including any birdies made during a playoff to win the Grand Prize described below. If Thursday’s round is cancelled for any reason, 500 birdies will be added to the total; if Friday-500; Saturday-300, and Sunday-300. The final number of birdies made will be determined and validated by the PGA TOUR. Only one Guess the Birdies entry per entry form. Maximum ten (10) entries per individual. The first ten entries processed per individual will be accepted. All entries for the Guess The Birdies Contest, including on-line, mail-in, and tournament grounds entries, must be received by Saturday, May 27th, 2006 at 5p.m (CST).  Mail-in entries must be received at Birdies for St. Jude, 501 St. Jude Place Memphis, TN 38105 by such time. (Only guesses submitted on official entry/pledge forms will be accepted. NO EXCEPTIONS! Handwriting is the responsibility of the person making the pledge and/or guess.  Proof of entry submission or sending will not be deemed to be proof of receipt by Sponsors. Sponsors are not responsible for late, lost, illegible, incomplete, un-received, misdirected, damaged or postage due mail and or entries.
  6. Determination of Winners: Grand Prize: One (1) Grand Prize will be awarded to the person who guesses the exact number of birdies made during the defined measurement period. In case of a tie, the Grand Prize winner will be determined by a random drawing among all participants who guessed the same number. If no one guesses the exact number of birdies, the winner will be the person who comes closest, over or under the actual birdie total.  In case of ties, the winner will be determined by a random drawing from among all participants who guessed the next closest number. The First Prize through the Seventh Prize awards will be given away pursuant to these rules via random drawings from all eligible entries, less the Grand Prize winning entry. The Grand Prize winner will not be entered into the random drawings for First Prize through Seventh Prize.

    Selection of all winners will be completed on or about August 5, 2006.  The Contest will be conducted on Sponsors' behalf by an independent judging organization whose decisions as to the administration of the Contest and the selection of the potential winners are final.  No appeal or further review will be permitted. Odds of winning the Grand Prize depend on the number of birdies made, eligible entries received and number of correct guesses.  Odds of winning the First Prize through the Seventh Prize awards depend on the number of eligible entries received. All entrants must comply with all terms and conditions of these Official Contest Rules. Sponsors will solely determine if all rules and conditions have been met and their decisions are final. The potential Grand Prize winner will be notified by phone and/or certified mail within ten (10) days of the determination. Except where prohibited, the potential Grand Prize winner must sign and return to the Sponsors’ designee, within ten (10) days of being notified, an affidavit of eligibility and liability/publicity release in order to claim his/her Prize. If the potential Grand Prize winner cannot be contacted within fourteen (14) days after the first attempt to contact him/her, if he/she fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period, or is otherwise found not to be eligible to win, the next eligible winner will be selected in his/her place pursuant to these rules.

    Fifth Prize:  Three (3), Dasani tote bag, water bottle & tee. AVR $20
    Sixth Prize: Fourteen (14), Dasani XL Tee shirt. AVR $15
    Seventh Prize: Sixty-two (62), Birdies XL tee shirt. AVR $12.00


    The Prize(s) are not transferable, may not be changed for alternate Prizes, and may not be exchanged for cash by the winners.  Prizes must be accepted as awarded.  No cash or other substitution may be made, except by the Sponsors, who reserve the right to substitute the Prizes with other Prizes of equal or greater value if the Prizes are not available for any reason as determined by the Sponsors in their sole discretion.  All expenses associated with any Prizes not specifically specified in these rules are the sole responsibility of the Prize winners including all taxes, licenses, incidentals and transportation.  Contest officials reserve the right to drive the Grand Prize vehicle for promotional and advertising purposes prior to the drawing. The Grand Prize winner must have a valid driver’s license, show proof of auto insurance and claim and take delivery of the vehicle in Memphis TN. Winners are responsible for any taxes and fees associated with receipt or use of any Prize. All Prizes unclaimed by October 1, 2005 will be forfeited.
  8. Publicity:  Except where prohibited, participation in the Contest constitutes winners' consent to Sponsors' use of winners' names, likenesses, voices, opinions, biographical information, hometown and state for promotional purposes in any media without further payment or consideration.
  9. GENERAL CONDITIONS:  In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsors may, in their sole discretion, either: (a) terminate the Contest  (b) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules; or (b) award the Prizes from among the eligible winners received up to the time of the impairment. The Sponsors reserve the right in their sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest, or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsors reserve the right to seek damages and other relief from and against any such person to the fullest extent permitted by law. The Sponsors’ failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
  10. RELEASE AND LIMITATIONS OF LIABILITY:  By participating in the Contest, entrants agree to release, indemnify and hold harmless the “Released Parties” from and against any claim, demand, cost, expense, or cause of action arising out of participation in the Contest or receipt or use of any Prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected,  undeliverable or un-received mail or entries; (e) errors in the administration of the Contest or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use of any Prize.  Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Contest, and in no event shall the Released Parties be liable for attorney’s fees.  Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
  11. CONTEST RESULTS:  To request a copy of the name of the winners, send a self-addressed, stamped envelope to Birdies for St. Jude Results, 501 St. Jude Place Memphis, TN 38105. Vermont residents may omit postage for Rules requests. Requests must be received by August 5, 2006.
