The St. Jude Mission Inspired Commander Message Fundraising Contest is a volunteer-based fundraising program conducted by American Lebanese Syrian Associated Charities, Inc. (“ALSAC”) to benefit St. Jude Children’s Research Hospital® (“St. Jude”). These Rules apply to all participants. The Sponsor (defined below) shall make all determinations as to whether the Rules have been complied with, and the decision of the Sponsor as to any issue is final.
Sponsor: ALSAC/St. Jude is the Sponsor of this Contest.
Eligibility: NO PURCHASE OR DONATION IS NECESSARY TO PARTICIPATE IN THE CONTEST. Participation is open only to legal residents of the 50 United States or the District of Columbia who are 18 years of age or older as of the date of entry. Employees of ALSAC and St. Jude and their immediate family members are not eligible to win. THIS CONTEST IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
For this purpose, “immediate family” includes the spouse, parents, grandparents, great-grandparents, brothers, sisters, children, grandchildren, and great-grandchildren of the employee and his/her spouse. This definition also includes a) “step” and adoptive relationships, b) individuals for whom an employee is the current legal guardian and c) individuals who are not legally related but who reside with an employee.
Time: The Contest starts at 12:01 am CST on March 1, 2021 and ends at 11:59 pm CST on August 31, 2021 (the “Contest Period”). All donations must be received by ALSAC during the Contest Period to be count toward a participant’s fundraising total.
Entry: During the Contest Period, participants can enter the Contest by registering as a fundraiser within the “Mission: Inspired” fundraising campaign and fundraising for St. Jude through your personal St. Jude Mission Inspired fundraising page.
By participating in the Contest, each participant fully and unconditionally agrees to, and accepts these, Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Contest. Sponsor may have similar offers or promotions at the same time as this Contest. Each Contest is separate. Entry into one Contest is not entry into any other Contest.
Prize: The prize consists of a digital personalized message recorded by Jared Isaacman during the Inspiration4 mission and delivered to Winner after the return of the Inspiration4 voyage (ARV: $1) (collectively, the “Prize” or "Contest Prize"). Contest Prize may not be redeemed for cash value. Actual value of the Contest Prize may be more or less. The difference in value as stated herein and value at the time of Prize notification, if any, will not be awarded in cash or otherwise. Only one Prize will be awarded per Winner. The prize is non-transferable.
Sponsor is responsible only for Prize delivery and not Prize utility. Sponsor reserves the right to substitute for the listed Contest Prize, or any portion thereof, one of equal or greater value if any advertised Prize becomes unavailable for any reason.
Determination of Winner: There will be five winners of the Contest. The Winners will be the top 5 fundraising individuals who raise the most money for St. Jude through an individual St. Jude Mission Inspired fundraising page during the Contest Period (each, a “Winner”). Each Winner will be determined and notified within 5 days of the end of the Contest Period. The Winner will be notified by email and/or phone. The selection of the Winners by the Sponsor is final and binding on all participants. A Winner does not need to be present to win.
A Prize may be forfeited and awarded to an alternative participant if the Winner does not respond within three (3) days of notification being sent to the Winner or if two (2) attempts to contact the Winner by email are not successful.
At Sponsor’s discretion, a background check ("Background Check") may be performed with respect to the potential winner as part of the process to confirm any potential winner's eligibility and compliance with these Official Rules, which Background Check such potential winner would have to pass in order to receive the prize. By entering the Contest, entrant agrees to cooperate fully with any such Background Check, and to execute and deliver to Sponsor or its designee all required authorizations and approvals for said Background Check to be conducted. Failure to cooperate may result in disqualification. If a background check reveals that a potential winner has engaged in conduct that could damage the reputation or business of Sponsor, as determined by Sponsor in its discretion, the potential winner may be disqualified and the prize may be awarded to an alternate potential winner, time permitting. In the event that a potential winner is disqualified for any reason or does not accept the Prize, Sponsor may award the applicable prize to an alternate potential winner.
Taxes: The value of the Prize is includible in the Winner’s income. ALSAC may be required to report the value of the Winner’s prize to the Internal Revenue Service. If requested, the Winner agrees to provide his or her valid name, address, and Social Security number to ALSAC for tax reporting purposes. The Winner is responsible for paying all federal, state, and local income and other applicable taxes that are due in connection with receipt of the Prize. Any other fees, costs and expenses not specified herein as being awarded (including but not limited to all additional meals, beverages, transportation and incidentals), are the sole responsibility of the Winner.
Additional Agreements: The Winner will be required to execute an Agreement with ALSAC/St. Jude and such other parties, including the Contest Prize provider, as a condition of accepting his/her prize. The agreement includes releases of liability in favor of ALSAC and St. Jude and prize provider. The selected Winner must execute all consents, waivers and releases as required by Sponsor or Prize Provider in accordance with applicable law.
Consent to Publicity: Unless restricted by law, by accepting the Prize, the Winner consents to ALSAC’s and St. Jude’s use of his or her name, voice, quotes, likeness and/or photograph in any publicity, publications, promotional and marketing material, advertising, and any other print materials, web pages, electronic or other communications published or distributed by ALSAC or St. Jude, without compensation and without notice, and to sign an agreement to this effect.
Miscellaneous Conditions: EACH POTENTIAL WINNER IS SUBJECT TO VERIFICATION BY SPONSOR. SPONSOR’S DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE ADMINISTRATION, OPERATION, SELECTION OF THE WINNER AND OTHER MATTERS RELATED TO THE CONTEST. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT'S ELIGIBILITY AND COMPLIANCE WITH THESE OFFICIAL RULES HAVE BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED BY SPONSOR THAT VERIFICATION IS COMPLETE.
Sponsor is not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines, Internet services or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Contest; (d) technical or human error in the administration of the Contest or the processing of entries; or (e) any injury or damage to persons or property that may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or receipt or use or misuse of any prize by Contest Winner; (f) electronic transmissions that are lost, late, stolen, incomplete, damaged or misdirected; (g) any problems or technical malfunctions, errors, omissions, deletions, defects, communication failures or (h) causes beyond the Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of the Contest. If for any reason an entrant's registration is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Contest. No more than the stated number of each prize will be awarded. ALSAC is not responsible if the Contest does not take place or is not completed or any prize cannot be awarded or fulfilled due to travel or event cancellations, unavailability, delays, interruptions due to acts of god, acts of war, natural disasters, weather, or terrorism or other circumstance beyond ALSAC’s control; in the event of such cancellation or unavailability after travel has been booked, the remainder of the trip will be awarded as the complete prize.
Sponsor makes no warranties, and hereby disclaims any and all warranties, express or implied, concerning any prize furnished in connection with the Contest. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, PRIZES ARE PROVIDED ON AN “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR AND/OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW LIMITATIONS OR EXCLUSIONS OF IMPLIED WARRANTIES SO SOME OF THE LIMITATIONS OR EXCLUSIONS IN THIS SECTION MAY NOT APPLY IN SUCH JURISDICTIONS.
By participating in the Contest, participants agree to release, discharge and hold harmless ALSAC and St. Jude and each of their affiliates, directors, officers, employees, and agents (“Released Parties”) from and against any and all injuries, claims, losses, damages, actions and/or liability arising out of or in connection with, directly or indirectly, participation in and/or entry into the Contest or acceptance, delivery, possession, use or misuse of any prize received in this Contest, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to an entrant's entry, creation of an entry or submission of an entry, participation in the Contest, travel, lodging, acceptance, possession, attendance at, defect in, delivery of, inability to use, use or misuse of Contest Prize, or any portion thereof (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry. Released Parties are not responsible if the Contest Prize, or any portion thereof, is delayed, postponed or cancelled for any reason, in which event that portion of the prize is forfeited in its entirety and no substitution will be provided except as in Sponsor's sole discretion. Contest Winner acknowledges that all prizes are awarded as-is, without warranty, representation or guarantee, express or implied, in fact or in law of any kind. The determinations of the Sponsor are final and binding with respect to any matter arising out of the interpretation or application of these Rules.
The Released Parties shall not have any obligation or responsibility, including any responsibility to award any prize to entrants, with regard to: (a) entries that contain inaccurate information or do not comply with or violate these Official Rules; (b) entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (c) entrants who have committed fraud or deception in entering or participating in the Contest or claiming the prize; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any inability of the Contest Winner to accept the prize for any reason; (f) if a prize cannot be awarded due to delays or interruptions due to Acts of God, natural disasters, terrorism, weather or any other similar event beyond Sponsor's or Sponsor's reasonable control; or (g) any damages, injuries or losses of any kind caused by any prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any prize or resulting from participating in this Contest or any promotion or prize related activities. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be (x) tampering with the entry process or the operation of the Contest, or with any website promoting the Contest; (y) acting in violation of these Official Rules; or (z) entering or attempting to enter the Contest more times than allowed in these Official Rules or the use of any robotic or automated devices to submit entries. If Sponsor determines, in its sole discretion, that technical difficulties, malfunction, error, disruption or damage or other unforeseen events compromise the administration, security, fairness, integrity, proper conduct or viability of the Contest, Sponsor reserves the right to void the entries at issue, and/or terminate the relevant portion of the Contest, including the entire Contest, and/or modify the Contest and/or award the prize from all eligible entries received as of the termination date. Sponsor reserves the right to suspend, modify or cancel any Contest before the scheduled Contest End Date. In the event a Contest is cancelled, all entries into such Contest will be deemed null and void, all donations will be refunded to the donors thereof, no winners will be selected and no rewards will be delivered.
Except where prohibited by law, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (b) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved exclusively by the United States District Court located in the Western District of Tennessee or the appropriate Tennessee State Court located in Shelby County, Tennessee; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees; and (d) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased; and (e) entrant's remedies are limited to a claim for money damages (if any) and entrant irrevocably waives any right to seek injunctive or equitable relief. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant or Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Tennessee, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the State of Tennessee.

Requests for the winner list must be received within 90 days of the end of the Contest Period.
